USE OF THE WEBSITE
Registration on the website is only permitted for users who are legally capable of entering into contracts and who act only in their name and on their behalf. .
Any activity or participation by users under the age of 18 is considered illegal and will not be tolerated by Arcádia®. Access to and use ofArcádia®'s functionalities, directly or through an intermediary, is prohibited for all accompanied minors and adults, whose measure decreed prevents the conclusion of these transactions.
In the case of a legal person, the User/Client declares to be its representative, with powers to carry out the act.
When using the Arcádia® platform, and when placing orders, the User/Customer is obliged to comply with these terms and conditions, namely:

2 - Fill out accurately, completely and truthfully all electronic forms relating to registration as a user, placing orders and any other forms available on the website you may use;
3 - Save and do not disclose your user code and access password to third parties;
4 - Do not use the website or any of the platforms and forms made available through it, to disseminate illegal, illicit or offensive content against general principles of law, ethics and public order;
5 – Refrain from using the website to make queries or orders that are legally invalid;

In order to place orders for products through theArcádia® website, the User/Customer must first register as a user by filling out the corresponding form available online.
The User/Client is responsible for keeping the data relating to his/her user registration up to date, including the details relating to his/her address. If the user believes, at any time, that the confidentiality of his/her data has been compromised, he/she must inform Arcadia® immediately through contact online@arcadia.pt .
AArcádia® will not be responsible for delays in processing any order or loss thereof, resulting from an error or insufficient data communicated by the User/ Customer.
After registering as a user, the User/Customer will be able to place orders, using the “virtual shopping cart” and following all the steps, including those relating to payment.
AArcádia® has no responsibility for transactions carried out with the user's account, whether or not these are recognized by the user.
AArcádia® considers the user's session valid from the moment they log in with the correct username and password . From that moment on, Arcádia® cannot be held responsible for the unauthorized use or improper use of personal data.
If any user account activity is observed that could be considered fraudulent and that does not comply with the activities contemplated in these Terms and Conditions, or in the event of verification of the occurrence of consumption patterns, or systematic repetitions, which may evidence the practice irregular or illegitimate behavior, Arcádia® reserves the right to investigate these same activities, transmitting to the competent authorities the results of the investigations carried out by carried out, with whom it will collaborate and whose guidance it will obey.
PRICES, CHARACTERISTICS AND AVAILABILITY OF PRODUCTS:
If the information presented on the website does not correspond to the characteristics of the product, the User/Customer has the right to terminate the purchase and sale contract concluded online, under the applicable legal terms and without prejudice to the conditions referred to below.
The User/Customer expressly accepts and declares to know the specifications of the products when placing their order, and agrees with them.
In case of erroneous information contained on the website of Arcádia® as for the specifications of the products, which were reasonably understandable by the User/Customer at the time of the order, this is not, in any way, opposable to Arcádia®.
The photographs presented on the website are for illustrative purposes only. Therefore, we recommend that you consult the product details for better information about the respective characteristics of the items you intend to purchase.
Product prices and specifications are subject to change without prior notice. DespiteArcádia® 's extreme attention to keeping all information up to date, some products may have an incorrect price, so we will check prices whenever we process orders. If this occurs, when processing the order, Arcádia® will inform the customer accordingly. In such a case the customer:
- You will be refunded the difference if the advertised price is higher than the actual sales price;
- You can choose to cancel the order, or, informed of the effective price and maintaining interest in it, pay the difference, if the effective price is higher than the advertised price.
AArcádia®, under no circumstances, will be obliged to supply any product at a lower price (even after order confirmation or dispatch has been sent) if the error in the price is obvious and unambiguous, and that error could have been reasonably recognized by the User/Customer as being an incorrect price.
The indication of stock availability, as well as delivery times, are merely indicative.
AArcádia®is not responsible for any discontinuation in the production or sale of products featured on itswebsite .
If, as a result of unavailability of stocks or delays in processing or dispatching the products ordered by the customer, it is impossible to fulfill the order within the expected delivery period indicated, , Arcádia® will contact the customer, who will be able to choose to keep the order and accept the new delivery time indicated, or cancel it, with the amount already paid being refunded.
In accordance with the provisions of Decree-Law no. 7/2004 of 7 January (with the amendments conferred by Decree-Law no. August), regarding electronic commerce,Arcádia®reserves the right to unilaterally cancel the order whenever a programming error occurs , computer malfunction, as well as in the event that the contractual proposal arrives deformed at its destination and the error concerns an essential element of the contract.
The indicated price of the products is, unless there is an insertion error or otherwise indicated, the retail price (including VAT at the legal rate in force). The price of any purchase made through the website is valid for the day on which the order is placed and paid.
The advertised prices do not include shipping costs, which will be indicated to the User/Customer before validating the order.
All data recorded by Arcádia® constitute proof of the set of transactions carried out between the Seller and the final Consumer, being It is the responsibility of Arcádia® to archive the electronic document in which the contract is formalized, and is obliged to keep it accessible.
ORDER PLACEMENT:
To place the order online:
- Register or Login to access your customer area.
- Browse the online store pages and find the product(s) you want to purchase.
- Add your favorite products to the Shopping Cart using the “Add to Cart” button.
- When you understand that you have already chosen all the products you want to purchase, navigate to the Shopping Cart page using the icon and complete the order by clicking on “Checkout”.

ONLINE STORE SECURITY
The Arcádia® online store uses the latest and most robust security technologies available for encryption platforms. All payment information you provide will be encrypted, from the initial moment of your transaction, until the moment the order is processed, and will not be stored on any public server.
Although we use highly advanced encryption software, any payment transmitted over the Internet, or via email, runs some risks, particularly when the Customer does not take due precautions and does not assume due responsibility.
AArcádia® cannot be held responsible for any damage suffered resulting from the use of electronic means of communication, particularly damage resulting from failures or delays in delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for communications or virus transmission.
SHIPPING AND DELIVERY
Where?
Only orders with a delivery address in mainland Portugal will be accepted.
Customer data must be completely and correctly filled out. If it is filled out incorrectly or incompletely, it may result in the order not being dispatched or preventing successful dispatch and delivery, and Arcádia® will not be held responsible for this. Any changes made to your account after placing an order will not be taken into account for that order, but only for future orders you place.
It is essential that someone is present to receive your order, as we only guarantee the quality of the product up to the delivery time limit. After this time we are not responsible for the quality and/or presentation of the product.
For greater convenience, you can request that your order be sent to another address of your choice. Make sure you enter the full address, as well as a contact name (if different) and mobile phone number to facilitate immediate delivery of your order.
If there is no one at the address indicated to receive the order within the defined time, the carrier will try to contact the number provided in the purchase order in order to arrange another time/date for delivery. If telephone contact is impossible, a notice will be left in the mailbox, with a number that the customer must contact with a view to rescheduling. However, the carrier will attempt to contact the customer a second time using the number provided in the purchase order in order to schedule a second delivery attempt. If this second attempt at telephone contact for rescheduling is impossible, the order will remain at one of the carrier's agencies for a maximum period of 15 (fifteen) days until it is possible to schedule the second delivery attempt. If delivery is not possible within these 15 (fifteen) days, for reasons attributable to the customer, we consider it definitively impossible to deliver the product, without the right to any refund.
In any circumstance, whenever the product is delivered after the deadline, Arcádia® is not responsible for its quality and presentation.

When?
After payment and confirmation of the order by Arcádia® on working days until 11:00 am, the delivery time for items purchased online is 2 working days for items with availability. If payment and order confirmation byArcádia®is made after 11 am on weekdays or at any time on weekends , the delivery time for items purchased online is3 working days.
How?
Your items will always be transported in appropriate packaging so that they reach the recipient in perfect condition, throughout the year, whether in winter or summer.
AArcádia® reserves the right not to ship its items in the event of specific weather conditions that it considers unsuitable and that may in any way call into question the good quality and presentation of the product, informing the customer in this case as soon as possible. During these periods of unfavorable weather conditions for the transport of Arcádia® products, the terms and conditions, as well as the delivery times mentioned above, do not apply, and the customer is duly informed of the specific changes through a banner located at the top of the website.
Some of the data provided (Name, Address, Postal Code, City, Contact) will be shared with the partner responsible for the Transport service so that deliveries can be made for purchases made online. You will only be contacted if there is a problem with the delivery. Your data will not be used for any other purpose. For more information, see our Privacy and Personal Data Protection Policy.
How much?
TRANSFER OF RISKS AND OWNERSHIP OF PRODUCTS IN ONLINE PURCHASES
As the User/Customer is considered a consumer, under the terms defined in consumer legislation, the risk of loss or damage to goods sent for delivery by Arcádia® transfers to the consumer when he or a third party indicated by him, other than the carrier, acquires physical possession of them.
In any other situations, the risk of loss or damage to the goods passes to the User/Customer upon delivery of the goods to the carrier.
Upon delivery, the User/Customer must check the conformity of the goods, namely the condition of the packaging, informing the carrier of any damages detected, mentioning them on the transport note that they sign.
If the goods show damage that is not visible at the time of delivery, but which is the result of poor transport, the customer must, within 2 days, contact, preferably in writing, the Arcadia® to the following email address online@arcadia.pt .
RIGHT OF FREE TERMINATION OF THE CONTRACT
It is important toArcádia®that you are completely satisfied with your purchase.
In this sense, if the User/Customer of the Arcádia® products is considered a consumer, for the purposes of consumer legislation, and purchasing the products through the online store, you have the right to terminate the contract within 14 (fourteen) days, counted under the following terms:
- The day on which the consumer or a third party, with the exception of the carrier, indicated by the consumer acquires physical possession of the goods, in the case of purchase and sale contracts;
- The day on which the consumer or a third party, with the exception of the carrier, indicated by the consumer acquires physical possession of the last good, in the case of several goods ordered by the consumer in a single order and delivered separately;
- The day on which the consumer or a third party, with the exception of the carrier, indicated by the consumer acquires physical possession of the last lot or element, in the case of the delivery of a good that consists of several lots or elements;
- From the day on which the consumer or a third party indicated by him, other than the carrier, acquires physical possession of the first good, in the case of contracts for the periodic delivery of goods during a certain period.
If the products were purchased by a User/Customer who does not qualify as a consumer for the purposes of consumer legislation, the general rules apply.
If you are a consumer, you may exercise your right to freely terminate the contract as long as the following conditions are met:
- Presentation of the product purchase invoice;
- The product must be delivered in the same conditions in which it was sold – presenting adequate quality and conditions, without signs of consumption or perishing and packed in the respective packaging;
The request for termination of the contract must be made by sending an unequivocal declaration of the intention to terminate or, alternatively, mentioning the full name, order number, and must include photographic records of the product, in order to assess its compliance.

If the User/Customer terminates the Contract by email,Arcádia® acknowledges, within 24 hours, the consumer of receipt of the resolution statement.
If the User/Customer chooses to exercise the right to freely terminate the contract by post, a notice of receipt of the declaration of termination on a durable medium will be sent within 48 hours.
In the event of exercising the right of free resolution, the User/Customer will bear, in full, the costs of returning the goods.
The User/Customer is responsible for any depreciation in the value of the product(s) purchased after delivery.
Likewise, the User/Customer will be responsible for any defect or non-conformity found in the product(s) caused by their transportation, whenever this is not the responsibility of Arcádia®.
After exercising the right to free resolution, the refund of the amount paid by the User/Customer, including, if applicable, the costs paid for the delivery of the goods at the time of purchase, will be made after validation of compliance with the return conditions , within a maximum period of 14 (fourteen) days.
For amounts paid by Credit Card or PayPal, the refund will be made to the same payment method. In the case of amounts paid through Multibanco or MBWAY, the refund will be made by bank transfer, with the IBAN being requested from the User/Customer during the refund process.
If the User/Customer wishes for the refund to be made through a different means, they must, within 5 (five) days from sending the declaration of termination of the contract, communicate their option in writing, providing all the necessary information, by one of the following means:

The refund may be withheld untilArcádia® has received the goods sent for return, or until the User/Customer presents proof of sending the goods goods, whichever comes first.
The User/Customer must return the goods without undue delay and no later than 14 (fourteen) days from the day on which they informed Arcádia® the free resolution of the contract, considering that it is respected if the User/Customer returns the goods before the end of that period of 14 (fourteen) days, provided that sending the products by mail is possible, without the loss of the same, and a shipping method must be adopted that ensures their quality and conservation. In this case, the User/Customer will have to bear the full costs of returning the goods.

The following are excluded from the Right to Free Resolution, under the terms described above:
- Supply of goods made according to consumer specifications or clearly personalized;
- Supply of goods that, by nature, cannot be resent or are susceptible to deteriorating or becoming quickly out of date;
- Supply of sealed goods that cannot be returned, for reasons of health protection or hygiene;
- Supply of goods that, after delivery and by nature, are inseparably mixed with other items;
- Any other exceptions contained in DL no. 24/2014, of February 14, when and if applicable.
CONSUMER GOODS WARRANTY
Products sold to Users/Customers, considered consumers for the purposes of consumer legislation, are covered by the legal regime Sale of Consumer Goods and Relative Guarantees, approved by Decree-Law nº 67/2003, of 8 April, in your current version.
As a rule, the conformity of purchased goods is guaranteed for a period of two years from the date of delivery of the product(s).
However, the food nature of the products sold means that the warranty period for food products supplied by Arcádia® may be shorter. Expiry dates are specifically indicated on all packaging of products supplied by Arcádia®, these being the deadlines for which Arcádia ®guarantees the conformity of the purchased goods.
If the purchased product presents any non-conformity, the User/Customer must communicate the situation, in writing, informing their order number and send a detailed description of the defect, including photographic records of the defect. You must do so by one of the following means:

The costs of returning or collecting items that do not comply with the contract, which are within the warranty period, will be borne by Arcádia®.
If the lack of conformity of the good is proven, the User/Customer who is a consumer has the right to have this replaced, free of charge, through repair or replacement, an appropriate price reduction or termination of the contract.
Product replacement, repair, termination of the contract or price reduction must be carried out within 30 (thirty) days after the defect is verified.
If the verification and evaluation carried out on the product(s) results in signs of non-conformity, particularly in terms of product conservation, intentionally or negligently, attributed to the User/Customer, they will not be able to benefit from the product(s). will benefit from the aforementioned guarantees.
The request for replacement, price reduction or termination of the contract must be made by email to online@arcadia.pt, detailing full name, order number, choice of replacement, repair, price reduction or contract termination option and must include photographic records of the product.
In case of replacement,Arcádia® will send a new product to the customer, which will be delivered upon collection of the damaged product, without that this entails any cost to the Customer/User.
In case of termination of the contract,Arcádia® will schedule the collection of the product, and once the product is delivered to its facilities , a full refund of the value of the product will be made.
For this purpose, the User/Customer must indicate their bank details in the email so that the refund can be processed.
RESPONSIBILITY
All products sold on the website https://arcadiachocolates.com are available in accordance with Portuguese legislation.
AArcádia®is not responsible for losses resulting from interference, interruptions, computer viruses, malfunctions or disconnections of the operating system that may temporarily prevent access, navigation or provision of services to the User/Customer.
Likewise,Arcádia®cannot be held responsible if the failure to fulfill its obligations is attributable to an unforeseeable or insurmountable fact of a third party, or that is, resulting from a force majeure reason.
It is the sole responsibility of the User/Customer to keep the information on their Customer account details correct and updated, through the Customer Area of our website, or through our Customer Support service.
AArcádia®declines any responsibility for any delay or impossibility of processing the order, particularly at the time of delivery, resulting from error or insufficiency or error of the data communicated by the User/Client.
The item(s) sold are described and presented on the website as accurately as possible. If, despite all our precautions, errors occur on the website or in the Arcádia® catalogs , it will not be held responsible for this fact.
Except in the case of application of consumer legislation, explained above, any operation carried out betweenArcádia® and its Users/Customers, is not contested , through the appropriate channels, within a period of 6 (six) months, cannot give rise to any claim or liability on the part of Arcádia®.
The User/Client does not have the right to transmit, assign, record or, in any other way, transfer a contract or any of the rights and obligations derived therefrom for his or her benefit, without prior consent, and in writing on a durable medium fromArcádia®.
AArcádia® may transmit, assign, record, subcontract or, in any other way, transfer a contract or any of the rights and obligations arising from the even for your benefit or in your favor, at any time, during the term of the contract, as long as this does not reduce the contractual or legal guarantees of the User/Customer.
Failure to exercise any right enjoyed byArcádia®does not correspond to the waiver or limitation of these rights or actions, nor will it exempt the User/Client from fulfillment of its obligations, reserving the possibility of exercising its rights within the legally established period.
FORM OF COMMUNICATIONS
In accordance with applicable legislation, by using this website the User/Client accepts that, as a rule, communications will be made in writing and in the form lasting.
In this sense, as a rule, contact with the User/Client will be made via the email address provided by them.
Furthermore, whenever necessary, Arcádia® will place notices to Users/Customers in this website.
Therefore, the User/Client accepts the use of electronic means of communication and acknowledges that all contracts, notifications, information and other communications sent electronically satisfy the legal requirement that such communications be made in writing. This condition will not affect legally recognized rights.
LOYALTY PROGRAM – CLUB ARCÁDIA®
What is it?
Clube Arcádia isArcádia®'s loyalty program, through which benefits are granted to customers for their consumption preference.
How to join?
Joining the program is free, and customers can join through the website. If you want to register now, click here .
Who can use it?
Membership is nominal and the benefits attributed are strictly personal, and it is not possible to sell or lend membership data. Each member has only one participation in the program, with the identification of the member participating in the program being personal and non-transferable. Each member's data cannot be transferred to third parties, and the user is responsible for all operations carried out with, for or through their account.
What are the benefits?
Arcádia®gives Arcádia Club members €1.00 for every €10.00 in products purchased, which can be used upon reaching €50.00 in purchases.
From time to time, Arcádia® may promote special temporary offers exclusive to members of the Arcadia Club.
Where to use?
Arcádia® is responsible for defining the Stores to be included in this Program, and may change, at any time, the list of participating stores.
You can always find complementary and updated information about the benefits of the program and participating units on our website.
Conditions, Cancellation and Changes to the Program
AArcádia® reserves the right to change the criteria for attributing benefits provided for in the Clube Arcádia program, as well as cancel or change the conditions of the program.
It is a condition of using the benefits that members are identified in the Clube Arcádia program using the Customer's mobile phone number. Arcádia reserves the right to cancel participation and benefits from the Arcádia Club whenever the member does not respect the Terms and Conditions of this program, does not comply with the conditions described or uses it in an abusive and/or fraudulent manner.
The benefits provided by the Clube Arcádia program are not compatible or cumulative with those of other promotions in force, except in cases where it indicates otherwise.
At any time, the member may decide to cancel their membership to the Clube Arcádia program, requesting the same via contact online@arcadia.pt . Cancellation implies leaving the program, ending the member's relationship with the program, and terminating the member's benefits under this program.
Upon eventual termination of the Clube Arcádia program, the Customer acknowledges that any points he/she has in his/her favor will be automatically cancelled, and there will be no right to reimbursement.
EXTRAJUDICIAL RESOLUTION OF CONSUMER DISPUTES:
In the event of a dispute, the User/Customer may resort to an Alternative Consumer Dispute Resolution Entity.

APPLICABLE LEGISLATION. JURISDICTION OF PORTUGUESE COURTS:
