The following Terms and Conditions apply to all visitors and customers of Arcádia® – a registered trademark managed and operated by Confeitarias Arca and Arcádia S.A. and Coffee Box-Cafetaria S.A. – as well as to members of Clube Arcádia and all commercial transactions carried out through our digital platforms.
This document establishes the conditions associated with the use of this website https://arcadiachocolates.com, which will apply to individuals and legal entities, as well as to any commercial transactions carried out.
By accepting these Terms and Conditions, you declare that you have read, understood, and fully agree with their content, and we advise you to read these general terms and conditions carefully before using our website.
By using this website, the User/Client is aware that they must comply with all terms and conditions and with our privacy policy. Consequently, if they do not agree with any of our policies, they should not use this website.
The present terms and conditions aim to define the general conditions of sale applicable to contracts concluded through our website, from the order processing act to the various services provided, including payment methods and delivery conditions of the goods.

USE OF THE WEBSITE
"Registration on the Arcádia® website is only permitted for users who are legally capable of entering into contracts and who act solely on their own behalf and for their own account."
Any activity or participation of users under the age of 18 is considered illegal and will not be tolerated by Arcádia®. Access to and use of the functionalities of Arcádia®, directly or through an intermediary, is prohibited for all minors and accompanied adults, whose decree prevents the conclusion of these transactions.
In the case of a legal entity, the User/Client declares to be its representative, with the authority to perform the act.
In using the Arcádia® platform, and when placing orders, the User/Customer agrees to comply with these terms and conditions, namely:
1 - Do not use the site for purposes other than obtaining information about the products and their respective sales conditions and/or for their acquisition;
2 - Fill in all electronic forms related to user registration, order placement, and any others provided on the site you may use, accurately, completely, and truthfully;
3 - Keep and do not disclose to third parties your user code and your access password ('Password');
4 - Do not use the site or any of the platforms and forms provided through it to disseminate illegal, unlawful, or offensive content that violates general principles of law, ethics, and public order;
5 – Refrain from using the website for making legally invalid inquiries or orders;
6 – Refrain from disclosing or disseminating any messages or information that are injurious, misleading, defamatory, obscene, of a xenophobic or discriminatory nature, or that violate, in any way, the right to privacy or the intellectual or industrial property of third parties, as well as any information that may be harmful to third parties or to the domain holder;
7 - Fully comply with all the terms of use of the site, as well as with transactions and contracts entered into through it.
In order to place product orders through the Arcádia® website, the User/Customer must first register as a user by filling out the respective form available online.
The User/Client is responsible for keeping the information related to their user registration up to date, including elements related to their address. If the user believes, at any time, that the confidentiality of their data has been compromised, they must inform Arcádia® immediately through the contact online@arcadia.pt.
Arcádia® will not be responsible for delays in processing any order or loss of the same, resulting from errors or insufficiency of the data communicated by the User/Client.
"After registering as a user, the User/Customer will be able to place orders using the 'virtual shopping cart' and following all the steps, including those related to payment."
Arcádia® has no responsibility for transactions made with the user's account, whether or not they are recognized by the user.
Arcádia® considers the user's session valid from the moment the login is initiated with the correct username and password. From that moment on, Arcádia® cannot be held responsible for unauthorized use or improper use of personal data.
"If any activity of the user account is observed that may be considered fraudulent and is not in accordance with the activities contemplated in these Terms and Conditions, or in the event of verification of consumption patterns, or systematic repetitions, that may evidence the practice of irregular or illegitimate behaviors, Arcádia® reserves the right to investigate such activities, transmitting the results of the investigations carried out to the competent authorities, with whom it will collaborate and to whose guidelines it will comply."
PRICES, FEATURES AND AVAILABILITIES OF PRODUCTS:
'In the event that the information presented on the website does not correspond to the characteristics of the product, the User/Customer has the right to terminate the online purchase and sale contract, under the applicable legal terms and without prejudice to the conditions mentioned below.'
The User/Client expressly accepts and declares to be aware of the specifications of the products at the time of their order, conforming to them.
In the event of incorrect information on the Arcádia® website regarding product specifications, which could have been reasonably understood by the User/Customer at the time of the order, such information shall not be, under any circumstances, enforceable against Arcádia®.
The photographs presented on the website are merely illustrative. Therefore, we recommend that you consult the product details for better information regarding the respective characteristics of the items you wish to purchase.
Please note that, in the event that the presented product is not available for delivery, but there is a possibility of producing it on order, it may not be exactly the same as the photograph shown, due to the essentially artisanal and/or manual production process.
The prices and specifications of the products are subject to change without prior notice. Despite Arcádia®'s utmost attention to keeping all information updated, some products may contain an incorrect price, so we will verify the prices whenever we process orders. Should this occur, at the time of processing the order, Arcádia® will inform the customer of this fact. In such a case, the customer:
●You will be reimbursed for the difference if the advertised price is higher than the actual selling price;
●You may choose to cancel the order, or if informed of the actual price and still interested in it, pay the difference if the actual price is higher than the advertised price.
Arcádia®, under no circumstances, shall be obliged to supply any product at a price lower (even after the order confirmation has been sent or its dispatch) if the pricing error is obvious and unequivocal, and that error could have reasonably been recognized by the User/Customer as an incorrect price.
The indication of stock availability, as well as delivery times, are merely indicative.
Arcádia® is not responsible for any eventual discontinuation in the production or sale of the products listed on its website.
In the event that, due to unavailability of stock or delays in processing or shipping of the products ordered by the customer, it becomes impossible to fulfill the order within the indicated delivery deadline, plus five business days, Arcádia® will contact the customer, who may choose to keep the order and accept the new indicated delivery deadline, or cancel it, with the amount already paid being refunded.
"In accordance with the provisions of Decree-Law No. 7/2004 of January 7 (with the amendments made by Decree-Law No. 62/2009, of March 10 and by Law No. 46/2012, of August 29), regarding electronic commerce, Arcádia® reserves the right to unilaterally cancel the order whenever a programming error occurs, a malfunction of the computers, as well as in the case where the contractual proposal arrives distorted at its destination and the error affects an essential element of the contract."
The indicated price of the products is, unless there is an input error or contrary indication, the retail price (including VAT at the legal rate in force). The price of any purchase made through the site is valid for the day the order is placed and paid.
The announced prices do not include shipping costs, which will be indicated to the User/Customer before the order validation.
Shipping costs are included in the price at checkout.
All data recorded by Arcádia® constitute proof of the set of transactions carried out between the Seller and the final Consumer, with Arcádia® being responsible for archiving the electronic document that formalizes the contract, committing to keep it accessible.
ORDER FULFILLMENT:
To place the order online:
1. Register or Log In to access your customer area.
2. Browse the pages of the online store and find the product(s) you wish to purchase.
3. Add your favorite products to the Shopping Cart using the "Add to cart" button.
4. Once you understand that you have selected all the products you wish to purchase, navigate to the Shopping Cart page via the icon and complete the order by clicking on "Checkout."
5. Proceed with the payment through the provided electronic platform.
6. You will receive an email with the confirmation of the availability of the chosen product(s) and the order, as well as the confirmation of the expected delivery time and the respective method.
PAYMENT AND PAYMENT METHODS
You can make payments with:

· Multibanco Reference;
· WAY;
· PayPal;
· SeQura (+info).
Orders become effective after payment, through one of the payment methods provided by Arcádia® for online purchases on the website. At no time will your banking details enter the computer system of Arcádia®.
For electronic payments via credit or debit cards, multibanco reference, as well as MBWAY®, a payment platform provided by SIBS is available, ensuring service quality and the best security guarantees. You can consult this partner's Privacy Policy here.
The SeQura payment method allows you to split the payment of your order into three, for purchases between €50 and €3,000. Learn more about this payment method here. We do not accept any other payment methods besides those mentioned.
ONLINE STORE SECURITY
The online store Arcádia® uses the latest and most robust security technologies available for encryption platforms. All payment information you provide will be encrypted, from the initial moment of your transaction until the moment the order is processed, and will not be stored on any public server.
'Although we use a very advanced encryption software, any payment transmitted over the Internet, or via email, carries some risks, particularly when the Client does not take the necessary precautions and does not assume the appropriate responsibilities.'
Arcádia® shall not be held liable for any damage suffered as a result of the use of electronic communication means, namely for damages arising from failures or delays in the delivery of electronic communications, from interceptions or manipulations of electronic communications by third parties or by computer programs used for communications or virus transmissions.
SHIPPING AND DELIVERY
Where?
Currently, we only accept orders with delivery addresses in Portugal and mainland Spain, as it has not yet been possible to ensure a logistics and transport network that guarantees the quality and food safety of the artisanal chocolate produced by Arcádia for shipments to countries in the European Union.
'Customer data must be fully and correctly filled out. Incorrect or incomplete filling may result in the non-shipment of the order or hinder the success of the shipment and delivery, with Arcádia® not being responsible for such an event. Any changes made to your account after placing an order will not be taken into account for that order, but only for future orders you place.'
"It is essential for someone to be present to receive your order, as we only guarantee the quality of the product up to the delivery time limit. After that time, we are not responsible for the quality and/or presentation of the product."
For your convenience, you can request that your order be sent to another address of your choice. Make sure to enter the complete address, as well as a contact name (if different) and mobile number to facilitate the immediate delivery of your order.
If no one is found at the specified address to receive the order within the defined time, the carrier will attempt to contact the number provided in the purchase order in order to arrange another time/date for delivery. In case of inability to make contact by phone, a notice will be left in the mailbox, with a number that the customer should contact for rescheduling. Nevertheless, the carrier will attempt to contact the customer a second time at the number provided in the purchase order in order to schedule a second delivery attempt. If it is not possible to make this second contact attempt for rescheduling, the order will remain at one of the carrier's agencies for a maximum period of 15 (fifteen) days until it is possible to schedule the second delivery attempt. If delivery cannot be made within these 15 (fifteen) days due to reasons attributable to the customer, we consider the definitive impossibility of delivering the product, with no right to any refund.
In any circumstance, whenever the product is delivered after the deadline, Arcádia® is not responsible for its quality and presentation.
When?
"After payment and confirmation of the order by Arcádia® on business days until 12:00 PM, the delivery time for items purchased online is 1 business day for items with immediate availability and delivery address in mainland Portugal. In the case that payment and confirmation of the order by Arcádia® is made after 12:00 PM on business days or at any time on the weekend, the delivery time for items purchased online is 2 business days. The delivery time for shipments to the islands is 2 to 3 business days after payment and confirmation of the order by Arcádia®. All deliveries are made only on business days."
In the case of orders during festive seasons and/or potential stock shortages, the previous deadline will not apply, and the customer will be duly informed of the specific changes through a banner located at the top of the website.
As?
Your items will always be shipped in appropriate packaging to ensure they arrive at the recipient in perfect condition, throughout the year, whether in Winter or in Summer.
Arcádia® reserves the right not to proceed with the shipment of its items in the case of specific weather conditions that it considers inappropriate and that may in some way jeopardize the good quality and presentation of the product, notifying the customer in this case as soon as possible. During these periods of unfavorable weather conditions for the transportation of Arcádia® products, the aforementioned terms and conditions, as well as the delivery times, do not apply, and the customer will be duly informed of the specific changes through a banner located at the top of the website.
Some of the data provided (Name, Address, Postal Code, City, Contact) will be shared with the partner responsible for the Transport service so that it is possible to carry out the deliveries of the purchases made online. You will only be contacted if there is a problem with the delivery. Your data will not be used for any other purpose. For more information, please consult our Privacy and Personal Data Protection Policy.
How much?
"All orders made in the Arcádia online store for delivery in mainland Portugal and mainland Spain through the partner responsible for the Transport service will incur a charge of €5.50 for transportation costs, which will be waived by Arcádia for purchases over €35.00."
"As for orders for delivery in the Azores and Madeira through the partner responsible for the Transport service, the transportation costs will be added according to the total weight of the order, regardless of the order value."
· For the Azores, transportation costs range from €42.50 for orders weighing up to 2kg to €105 for orders between 9kg and 10kg.
· For Madeira, the prices range from €57.50 for orders up to 2kg and €117.50 for orders weighing between 9kg and 10kg.
TRANSFER OF RISKS AND OWNERSHIP OF PRODUCTS IN ONLINE PURCHASES
'If the User/Client is considered a consumer, as defined in consumer legislation, the risk of loss or damage to the goods sent for delivery by Arcádia® transfers to the consumer when he or a third party indicated by him, who is not the carrier, takes physical possession of the goods.'
In any other situations, the risk of loss or damage to the goods transfers to the User/Client upon delivery of the merchandise to the carrier.
Upon delivery, the User/Client must verify the compliance of the goods, namely the condition of the packaging, informing the carrier of any damages detected, mentioning them on the transport document that they sign.
If the goods show damages not visible at the time of delivery, but resulting from inadequate transportation, the customer must, within 2 (two) days, contact Arcádia® preferably in writing at the following email address online@arcadia.pt.

RIGHT OF FREE TERMINATION OF THE CONTRACT
"It is important for Arcádia® that you are completely satisfied with your purchase."
'In this regard, in the case that the User/Client of Arcádia® products is considered a consumer, for the purposes of consumer legislation, and purchasing the products through the online store, they have the right to withdraw from the contract within 14 (fourteen) days, counted in the following terms:'
-From the day the consumer or a third party, except for the carrier, indicated by the consumer takes physical possession of the goods, in the case of purchase and sale contracts;
-On the day the consumer or a third party, except for the carrier, indicated by the consumer takes physical possession of the last item, in the case of multiple items ordered by the consumer in a single order and delivered separately;
-On the day the consumer or a third party, except for the carrier, indicated by the consumer takes physical possession of the last lot or item, in the case of the delivery of a good that consists of several lots or items;
-From the day on which the consumer or a third party indicated by him, who is not the carrier, takes physical possession of the first good, in the case of contracts for the periodic delivery of goods over a specified period.
If the products have been purchased by a User/Client who does not qualify as a consumer for the purposes of consumer legislation, the general rules apply.
If you are a consumer, you may exercise the right of free cancellation of the contract provided that the following conditions are met:
Presentation of the product purchase invoice;
The product must be delivered in the same conditions in which it was sold – presenting quality and adequate conditions, without signs of use or spoilage and packaged in the respective packaging;
The request for contract termination must be made by sending an unequivocal declaration of the intention to terminate or, alternatively, the "Free Termination Model" available here, mentioning the full name, order number, and must necessarily include photographic records of the product, in order to assess its compliance.
The termination of the contract may be carried out by one of the following means and addresses:

If the User/Client proceeds to terminate the Contract by email, Arcádia® acknowledges receipt of the termination statement to the consumer within 24 hours.
If the User/Client chooses to exercise the right of free termination of the contract by postal means, a notice of receipt of the termination declaration will be sent within 48 hours on a durable medium.
In the case of exercising the right of free resolution, the User/Client will bear, in full, the costs of returning the goods.
The User/Customer is responsible for any depreciation in the value of the purchased product(s) after their delivery.
In the same way, the User/Client will be responsible for any defect or non-conformity found in the product(s) caused by their transportation, whenever this is not the responsibility of Arcádia®.
"After exercising the right of free Resolution, the refund of the amount paid by the User/Client, including, if applicable, the costs incurred for the delivery of the good at the time of purchase, will be made after validating compliance with the return conditions, within a maximum period of 14 (fourteen) days."
For amounts paid by Credit Card or PayPal, the refund will be made to the same payment method. In the case of amounts paid through Multibanco or MBWAY, the refund will be made by bank transfer, with the IBAN requested from the User/Customer during the refund process.
If the User/Client wishes the refund to be made through a different means, they must, within 5 (five) days from the sending of the declaration of contract termination, communicate their option in writing, providing all necessary information, by one of the following means:

"The refund may be withheld until Arcádia® has received the goods returned, or until the User/Customer provides proof of shipment of the goods, whichever occurs first."
The User/Customer must return the goods without unjustified delay and no later than 14 (fourteen) days from the day they informed Arcádia® of the free resolution of the contract, being considered respected if the User/Customer returns the goods before the end of this 14 (fourteen) day period, provided that the shipment of the products by mail is possible, without their deterioration, and a shipping method that ensures their quality and preservation must be adopted. In this case, the User/Customer will have to bear the full costs of returning the goods.

The following contracts are excluded from the Right of Free Resolution, as described above:
-Supply of goods made according to consumer specifications or manifestly personalized;
-Supply of goods that, by their nature, cannot be returned or are likely to deteriorate or become quickly out of date;
-Supply of sealed goods not susceptible to return, for reasons of health or hygiene protection;
-Supply of goods that, after their delivery and by nature, become inseparably mixed with other items;
-Any other exceptions provided for in DL No. 24/2014, of February 14, when and if applicable.
CONSUMER GOODS WARRANTY
The products sold to Users/Clients, considered consumers for the purposes of consumer legislation, are covered by the legal regime of Sale of Consumer Goods and the related Guarantees, approved by Decree-Law No. 67/2003, of April 8, in its current version.
As a rule, the conformity of the acquired goods is guaranteed for a period of two years from the date of delivery of the product(s).
However, the perishable nature of the food products sold means that the warranty period for food products supplied by Arcádia® may be shorter. The expiration dates are specifically indicated on all packaging of the products supplied by Arcádia®, which are the periods for which Arcádia® guarantees the compliance of the purchased goods.
"If the purchased product presents any non-conformity, the User/Customer must communicate the situation in writing, informing about the order number and sending a detailed description of the defect, including photographic records of it. This should be done by one of the following means:"

"The costs for the return or collection of items that do not comply with the contract, which are within the warranty period, will be borne by Arcádia®."
In case of proven non-compliance of the good, the User/Customer who is a consumer has the right to have it restored, at no cost, through repair or replacement, to an appropriate reduction of the price or to the resolution of the contract.
The replacement of the product, its repair, the termination of the contract, or the reduction of the price must be carried out within 30 (thirty) days after the defect has been verified.
"If the verification and assessment carried out on the product(s) result in signs of non-compliance, particularly regarding the conservation of the products, due to willful or negligent actions attributed to the User/Client, the same will not benefit from the aforementioned guarantees."
The request for replacement, price reduction, or contract termination must be made by email to online@arcadia.pt, detailing full name, order number, choice of replacement, repair, price reduction, or contract termination option, and must necessarily include photographic records of the product.
In case of replacement, Arcádia® will send a new product to the customer, which will be delivered upon collection of the damaged product, without any cost to the Customer/User.
In case of contract termination, Arcádia® will schedule the collection of the product, and once the product is delivered to its facilities, a full refund of the product's value will be processed.
For this purpose, the User/Client must indicate in the email the bank details so that the refund can be processed.
RESPONSIBILITY
All products sold on the website https://arcadiachocolates.com are in compliance with Portuguese legislation.
Arcádia® is not responsible for losses resulting from interferences, interruptions, computer viruses, malfunctions, or disconnections of the operating system that may temporarily prevent access, navigation, or the provision of services to the User/Client.
Similarly, Arcádia® shall not be held liable if the non-fulfillment of its obligations is attributable to an unforeseeable or insurmountable event caused by a third party, that is, resulting from a force majeure.
"It is the sole responsibility of the User/Client to keep their account information correct and up to date, through the Client Area of our website, or through our Customer Support service."
Arcádia® disclaims any responsibility for any delay or inability to process the order, particularly at the time of delivery, resulting from errors or insufficiencies in the data provided by the User/Customer.
The sold item(s) are described and presented on the website with the utmost accuracy possible. If, despite all our precautions, errors occur on the website or in the Arcádia® catalogs, the company will not be held responsible for such an occurrence.
"Except in the case of application of the consumer legislation explained above, any operation carried out between Arcádia® and its Users/Clients, not contested through the appropriate channels within a period of 6 (six) months, cannot give rise to any claim or liability of Arcádia®."
The User/Client does not have the right to transmit, assign, record, or in any other way transfer a contract or any of the rights and obligations derived from it for their benefit or for themselves, without prior written consent in a durable medium from Arcádia®.
Arcádia® may transmit, assign, record, subcontract or, in any other way, transfer a contract or any of the rights and obligations derived from it for its benefit or in its favor, at any time during the term of the contract, provided that such does not diminish the contractual or legal guarantees of the User/Client.
The non-exercise of any right that belongs to Arcádia® does not correspond to the waiver or limitation of those rights or actions, nor will it exempt the User/Client from fulfilling their obligations, reserving the possibility of exercising their rights within the legally stipulated timeframe.
FORM OF COMMUNICATIONS
'Under the terms of the applicable legislation, by using this website the User/Client agrees that, as a rule, communications will be made in writing and on a durable medium.'
In this regard, as a rule, contact with the User/Client will be made through the email address provided by them.
Furthermore, whenever necessary, Arcádia® will place notices to Users/Clients on this website.
Thus, the User/Client accepts the use of electronic means of communication and acknowledges that all contracts, notifications, information, and other communications sent electronically meet the legal requirement that such communications be made in writing. This condition will not affect legally recognized rights.
LOYALTY PROGRAM – ARCÁDIA® CLUB
What is it?
The Arcádia Club is the loyalty program of Arcádia®, through which benefits are granted to customers for their consumption preference at the same.
How to join?
"Joining the program is free, and the customer can sign up through the website. If you wish to register now, click here."
Who can use it?
Membership is nominal and the benefits assigned are strictly personal, and it is not possible to sell or lend the membership data. Each member has only one participation in the program, with the member's identification in the program participation being personal and non-transferable. The data of each member cannot be transferred to third parties, and the user is responsible for all operations carried out with, for, or through their account.
What are the benefits?
Arcádia® awards members of the Arcádia Club 1 point for every €10.00 spent on products purchased. When you accumulate 5 points, you earn a €2.50 voucher that can be used on future purchases.
"Punctually, Arcádia® may promote special temporary offers exclusive to members of the Arcádia Club."
Where to use?
"It is up to Arcádia® to define the Stores to be included in the present Program, and to change, at any time, the list of participating stores."
You can always find complementary and updated information about the benefits of the program and participating units on our website.
Conditions, Cancellation and Changes to the Program
Arcádia® reserves the right to change the criteria for granting benefits provided in the Arcádia Club program, as well as to cancel or alter the conditions of the program.
"It is a condition for the use of the benefits to identify the members in the Clube Arcádia program through the Client's mobile number. Arcádia reserves the right to cancel the participation and benefits of the Clube Arcádia whenever the member does not comply with the Terms and Conditions of this program, does not meet the described conditions, or uses it in an abusive and/or fraudulent manner."
The benefits conferred by the Clube Arcádia program are not compatible or cumulative with those of other ongoing promotions, unless otherwise indicated.
At any time, the member may decide to cancel their membership in the Arcádia Club program by requesting it through the contact online@arcadia.pt. The cancellation implies leaving the program, ending the member's relationship with the program, and extinguishing the member's benefits under this program.
At the eventual termination of the Clube Arcádia program, the Client acknowledges that any points they may have in their favor will be automatically canceled, and there will be no right to reimbursement.
EXTRAJUDICIAL RESOLUTION OF CONSUMER CONFLICTS:
In the event of a dispute, the User/Client may resort to an Alternative Dispute Resolution Entity for consumer disputes.
