The following Terms and Conditions apply to all visitors and customers of Arcádia® – a registered trademark managed and operated by Confeitarias Arca e Arcádia S.A. and Coffee Box-Cafetaria S.A. –, as well as to Clube Arcádia members and all commercial transactions made through our digital platforms.

 

This document establishes the conditions associated with the use of this website https://arcadiachocolates.com, which will apply to individuals and legal entities, as well as to any commercial transactions carried out.

 

By accepting these Terms and Conditions, you declare that you have read, understood, and fully agree with their content, so we advise you to carefully read these general terms and conditions before using our website.

 

By using this website, the User/Client is aware that they must comply with all terms and conditions and our privacy policy. Consequently, if you do not agree with any of our policies, you should not use this website.

 

These terms and conditions aim to define the general sales conditions applicable to contracts concluded through our website, from the order processing act to the various services provided, including payment methods and delivery conditions of goods.

 

We emphasize that, whenever justified, these terms and conditions may be unilaterally changed. Therefore, we recommend reading them carefully and periodically.

- Coffee Box-Cafetaria S.A., a public limited company, headquartered at Rua do Almada, nºs 61/63, Porto, 4050-036 Porto, registered at the Porto Commercial Registry Office, under the unique corporate registration number 506 513 483 and with a share capital of 500,000.00 Euros.

 

WEBSITE USE

 

Only legally capable users for contract conclusion who act solely on their own behalf and account are allowed to register on the Arcádia® website.

 

Any activity or participation of users under 18 years of age is considered illegal and will not be tolerated by Arcádia®. Access to and use of Arcádia® functionalities, directly or through an intermediary, is prohibited for all minors and accompanied adults whose court-ordered measure prevents the conclusion of these transactions.

 

If the User/Client is a legal entity, they declare to be its representative, with powers to perform the act.

 

When using the Arcádia® platform and placing orders, the User/Client agrees to comply with these terms and conditions, namely:

 

 

1 - Do not use the site for purposes other than obtaining information about products and their sales conditions and/or for their purchase;

 

2 - Accurately, fully, and truthfully fill out all electronic forms related to user registration, order placement, and any others made available on the site that you use;

 

3 - Keep and do not disclose to third parties your user code and your access password ('Password');

 

4 - Do not use the site or any of the platforms and forms provided through it to disclose illegal, illicit, or offensive content against general principles of law, ethics, and public order;

 

5 – Refrain from using the website to make legally invalid inquiries or orders;

 

6 – Refrain from disclosing or spreading any injurious, misleading, defamatory, obscene, xenophobic, or discriminatory messages or information, or that in any way violates the right to privacy or the intellectual or industrial property of third parties, as well as any information that may be harmful to third parties or to the domain holder;

 

7 - Fully comply with all the terms of use of the site, as well as transactions and contracts entered into through it.

 

 

To be able to place product orders through the Arcádia® website, the User/Client must first register as a user by filling out the respective form available online.

 

The User/Client is responsible for always keeping the data related to their user registration updated, including elements related to their address. If the user believes at any time that the confidentiality of their data has been compromised, they must inform Arcádia® immediately through the contact online@arcadia.pt.

 

Arcádia® will not be responsible for delays in processing any order or its loss, resulting from errors or insufficiency of the data provided by the User/Client.

 

After registering as a user, the User/Client may place orders using the "virtual shopping cart" and following all the steps, including those related to payment.

 

Arcádia® has no responsibility for transactions made with the user account whether or not they are recognized by the user themselves.

 

Arcádia® considers the user session valid from the moment the login is made with the correct username and password. From that moment, Arcádia® cannot be held responsible for unauthorized use or improper use of personal data.

 

If any user account activity is observed that may be considered fraudulent and not in accordance with the activities contemplated in these Terms and Conditions, or if patterns of consumption or systematic repetitions are verified that may indicate irregular or illegitimate behavior, Arcádia® reserves the right to investigate such activities, transmitting the results of its inquiries to the competent authorities, with whom it will cooperate and whose guidelines it will follow.

 

PRICES, CHARACTERISTICS, AND AVAILABILITY OF PRODUCTS:

 

If the information presented on the site does not correspond to the product characteristics, the User/Customer has the right to terminate the online purchase and sale contract, under applicable legal terms and without prejudice to the conditions mentioned below.

 

The User/Customer expressly accepts and declares to know the product specifications at the time of their order, conforming to them.

 

In case of erroneous information on the Arcádia® website regarding product specifications, which could have been reasonably understood by the User/Customer at the time of the order, this is not, under any circumstances, enforceable against Arcádia®.

 

The photographs shown on the site are for illustrative purposes only. Therefore, we recommend that you consult the product details for better information about the respective characteristics of the items you intend to purchase.

 

Please note that if the presented product is not available for delivery, but there is the possibility of producing it to order, it may not be exactly the same as the photograph shown, due to the essentially artisanal and/or manual production process.

 

Prices and product specifications are subject to change without prior notice. Despite Arcádia®'s extreme care to keep all information updated, some products may contain an incorrect price, so we will verify prices whenever we process orders. If this occurs at the time of order processing, Arcádia® will inform the customer of this fact. In such a case, the customer:

 

●You will be refunded the difference if the advertised price is higher than the actual selling price;

 

●You may choose to cancel the order, or, being informed of the actual price and maintaining interest in it, pay the difference if the actual price is higher than the advertised price.

 

Arcádia® will never be obliged to supply any product at a lower price (even after sending the order confirmation or its shipment) if the price error is obvious and unequivocal, and that error could have been reasonably recognized by the User/Customer as an incorrect price.

 

The indication of stock availability, as well as delivery times, are merely indicative.

 

Arcádia® is not responsible for any discontinuation in the production or sale of the products listed on its website.

 

If, due to stock unavailability or delays in processing or shipping the products ordered by the customer, it is impossible to fulfill the order within the indicated delivery time plus five business days, Arcádia® will contact the customer, who may choose to keep the order and accept the new indicated delivery time or cancel it, with a refund of any amount already paid.

 

Under the provisions of Decree-Law No. 7/2004 of January 7 (as amended by Decree-Law No. 62/2009 of March 10 and Law No. 46/2012 of August 29), relating to electronic commerce, Arcádia® reserves the right to unilaterally cancel the order whenever a programming error, computer malfunction occurs, or if the contractual proposal arrives distorted at its destination and the error affects an essential element of the contract.

 

The indicated product price is, unless there is an input error or otherwise stated, the retail price (including VAT at the legal rate in force). The price of any purchase made through the site is valid for the day the order is placed and paid.

 

The advertised prices do not include shipping costs, which will be indicated to the User/Customer before order validation.

 

Shipping costs are included in the price at the time of order completion.

 

All data recorded by Arcádia® constitute proof of the set of transactions carried out between the Seller and the final Consumer, with Arcádia® being responsible for archiving the electronic document formalizing the contract, committing to keep it accessible.

 

ORDER PLACEMENT:

 

To place an order online:

 

1. Register or log in to access your customer area.

 

2. Browse the online store pages and find the product(s) you want to purchase.

 

3. Add your preferred products to the Shopping Cart using the “Add to cart” button.

 

4. When you consider that you have chosen all the products you want to purchase, navigate to the Shopping Cart page via the icon and complete the order by clicking “Checkout”.

 

5. Proceed with the payment through the provided electronic platform.

 

6. You will receive an email confirming the availability of the chosen product(s) and the order, as well as the expected delivery time and the respective method.

 

 

PAYMENT AND PAYMENT METHODS

 

You can make payments with:

 

·        Credit or debit cards;

·        Multibanco Reference;

·        MBWAY;

·        PayPal;

·        SeQura (+info).

 

Orders become effective after payment, through one of the payment methods provided by Arcádia® for online purchases on the site. At no time will your bank details enter Arcádia®'s computer system.

 

For electronic payments via credit or debit cards, multibanco reference, as well as MBWAY®, a payment platform provided by SIBS is used, which ensures service quality and the best security guarantees. You can consult this partner's Privacy Policy here.

 

The SeQura payment method allows you to split the payment of your order into three installments, for purchases between €50 and €3,000. Learn more about this payment method here. We do not accept any other payment method besides those mentioned.

 

ONLINE STORE SECURITY

 

The Arcádia® online store uses the latest and most robust security technologies available for encryption platforms. All payment information you provide will be encrypted from the initial moment of your transaction until the order is processed, and will not be stored on any public server.

 

Although we use very advanced encryption software, any payment transmitted over the Internet, or via email, carries some risks, especially when the Customer does not take the necessary precautions and does not assume the appropriate responsible conduct.

 

Arcádia® cannot be held responsible for any damage suffered resulting from the use of electronic communication means, namely damages arising from failures or delays in the delivery of electronic communications, interceptions or manipulations of electronic communications by third parties or by computer programs used for communications or virus transmissions.

 

SHIPPING AND DELIVERY

Where?

 

Currently, we only accept orders with a delivery address in Portugal and Peninsular Spain, as it has not yet been possible to ensure a logistics and transport network that guarantees the quality and food safety of the artisanal chocolate produced by Arcádia for shipments to other countries in the European Union.

 

Discount codes associated with Shipping Costs are only valid for orders placed for Mainland Portugal and Peninsular Spain.

 

Customer data must be fully and correctly completed. Incorrect or incomplete completion may result in the order not being shipped or may prevent the successful shipment and delivery, with Arcádia® not being responsible for such fact. All changes made to your account after placing an order will not be considered for that order, but only for future orders you place.

 

It is essential that someone is present to receive your order, as we only guarantee the full quality of the product up to the delivery time limit. After that time, we are not responsible for the quality and/or presentation of the product.

 

For greater convenience, you can request that your order be sent to another address of your choice. Make sure to enter the full address, as well as a contact name (if different) and a national mobile phone number to facilitate immediate delivery of your order.

 

If no one is found at the indicated address to receive the order within the defined time, the carrier will try to contact the number provided in the purchase order to arrange another delivery time/date. If telephone contact is not possible, a notice will be left in the mailbox with a number the customer should call to reschedule. Nevertheless, the carrier will try again to contact the customer a second time at the number provided in the purchase order to schedule a second delivery attempt. If this second telephone contact attempt for rescheduling is not possible, the order will remain at one of the carrier's agencies for a maximum period of 15 (fifteen) days until it is possible to schedule the second delivery attempt. If within these 15 (fifteen) days delivery cannot be made due to reasons attributable to the customer, we consider the delivery of the product definitively impossible, without any right to a refund. If during this period, and after contact with the Arcádia® Customer Support team, the customer shows intention to schedule a 3rd delivery attempt by the carrier, this will require an additional payment corresponding to the shipping cost charged in the online store, via bank transfer. After sending proof of payment, the carrier will be instructed to make a 3rd delivery attempt. Each additional delivery attempt of the customer's order corresponds to the payment of additional shipping costs. During this period and after consecutive delivery failures, and with confirmation of the order delivered at the carrier's agency, the customer may also choose to pick up their order at the corresponding carrier's agency. In any circumstance, whenever the product is delivered outside the deadline or under conditions beyond the normal delivery time agreed with the carrier, Arcádia® is not responsible for the quality and presentation of the product.

 

When?

 

After payment and order confirmation by Arcádia® on business days until 12:00 PM, the delivery time for items purchased online is 1 business day for items with immediate availability and delivery address in Mainland Portugal and Peninsular Spain. If payment and order confirmation by Arcádia® is made after 12:00 PM on business days or at any time on weekends, the delivery time for items purchased online is 2 business days. The delivery time for shipments to the islands is 2 to 3 business days after payment and order confirmation by Arcádia®. All deliveries are made only on business days.

 

In the case of orders during festive seasons and/or possible stock shortages, the previous deadline will not apply, and the customer will be duly informed of specific changes through a banner located at the top of the site.

 

How?

 

Your items will always be transported in appropriate packaging to arrive at the recipient in perfect condition, throughout the year, whether in Winter or Summer.

 

Arcádia® reserves the right not to ship your items in case of specific weather conditions or natural disasters that it considers inappropriate and that may somehow compromise the good quality and presentation of the product, notifying the customer as soon as possible in such cases. During these periods of unfavorable weather conditions or natural disasters for the transport of Arcádia® products, the above-mentioned terms and conditions, as well as delivery times, do not apply, and the customer will be duly informed of specific changes through a banner located at the top of the site.

 

Some of the provided data (Name, Address, Postal Code, City, Contact) will be shared with the partner responsible for the Transport service to enable the delivery of online purchases. You will only be contacted if there is a problem with the delivery. Your data will not be used for any other purpose. How much?

 

For all orders placed in the Arcádia online store for delivery in Mainland Portugal and Peninsular Spain through the partner responsible for the Transport service, a transport cost of €5.50 will be added, which will be offered by Arcádia for purchases over €40.00.

 

Regarding orders for delivery to the Azores and Madeira through the partner responsible for the Transport service, the value of the shipping costs will be added according to the total weight of the order, regardless of the order value.

 

·        For the Azores, shipping costs range from €42.50 for orders weighing up to 2kg and €105 for orders between 9kg and 10kg.

·        For Madeira, the amounts range from €57.50 for orders up to 2kg and €117.50 for orders weighing between 9kg and 10kg.

 

TRANSFER OF RISKS AND OWNERSHIP OF PRODUCTS IN ONLINE PURCHASES

If the User/Client is considered a consumer, as defined in consumer legislation, the risk of loss or damage to goods sent for delivery by Arcádia® transfers to the consumer when they or a third party indicated by them, other than the carrier, acquires physical possession of the goods.

 

In any other situations, the risk of loss or damage to the goods transfers to the User/Client upon delivery of the merchandise to the carrier.

 

Upon delivery, the User/Client must check the conformity of the goods, namely the condition of the packaging, informing the carrier of any detected damages, making note of them on the delivery note they sign.

 

If the goods show damages not visible at the time of delivery, but resulting from poor transportation, the customer must, within 2 (two) days, preferably in writing, contact Arcádia® at the following email address online@arcadia.pt.

RIGHT OF FREE CONTRACT CANCELLATION

It is important for Arcádia® that you are completely satisfied with your purchase.

 

In this regard, if the User/Client of Arcádia® products is considered a consumer for the purposes of consumer legislation, and acquires the products through the online store, they have the right to cancel the contract within 14 (fourteen) days, counted as follows:

 

-From the day the consumer or a third party, except the carrier, indicated by the consumer acquires physical possession of the goods, in the case of purchase and sale contracts;

 

-From the day the consumer or a third party, except the carrier, indicated by the consumer acquires physical possession of the last good, in the case of several goods ordered by the consumer in a single order and delivered separately;

 

-From the day the consumer or a third party, except the carrier, indicated by the consumer acquires physical possession of the last batch or element, in the case of delivery of a good consisting of several batches or elements;

 

-From the day the consumer or a third party indicated by them, who is not the carrier, takes physical possession of the first good, in the case of contracts for periodic delivery of goods over a certain period.

 

If the products were purchased by a User/Client who does not qualify as a consumer for the purposes of consumer legislation, general rules apply.

 

If you are a consumer, you may exercise the right of free termination of the contract provided the following conditions are met:

 

Presentation of the product purchase invoice;

The product must be delivered in the same condition in which it was sold – presenting adequate quality and conditions, without signs of use or deterioration and packaged in its respective packaging;

 

The request for contract Termination must be made by sending an unequivocal statement of the intention to terminate or, alternatively, the “Model of Free Termination” available here, mentioning the full name, order number, and must necessarily include photographic records of the product to assess its conformity.

 

The contract Termination may be made by one of the following means and addresses:

If the User/Client proceeds with the Contract Termination by email, Arcádia® will acknowledge receipt of the termination statement to the consumer within 24 hours.

 

If the User/Client chooses to exercise the right of free termination of the contract by postal means, a receipt notice of the termination statement will be sent within 48 hours on durable medium.

 

In the case of exercising the right of free termination, the User/Client will bear, in full, the costs of returning the goods.

 

The User/Client is responsible for any depreciation in the value of the purchased product(s) after delivery.

 

Likewise, the User/Client will be responsible for any defect or non-conformity found in the product(s) caused by their transport, whenever this is not the responsibility of Arcádia®.

 

After exercising the right of free Termination, the refund of the amount paid by the User/Client, including, if applicable, the costs paid for the delivery of the good at the time of purchase, will be made after validating compliance with the return conditions, within a maximum period of 14 (fourteen) days.

 

For amounts paid by Credit Card or PayPal, the refund will be made to the same payment method. In the case of amounts paid through Multibanco or MBWAY, the refund will be made by bank transfer, with the IBAN requested from the User/Client during the refund process.

 

If the User/Client wishes the refund to be made through a different method, they must, within 5 (five) days from sending the contract termination statement, communicate their choice in writing, providing all necessary information, by one of the following means:

The refund may be withheld until Arcádia® has received the goods returned or until the User/Client provides proof of sending the goods, whichever occurs first.

 

The User/Client must return the goods without undue delay and no later than 14 (fourteen) days from the day they informed Arcádia® of the free resolution of the contract, considering that this is respected if the User/Client returns the goods before the end of this 14 (fourteen) day period, provided that sending the products by mail is possible without their deterioration, and a shipping method that ensures their quality and preservation must be adopted. In this case, the User/Client will bear the full cost of returning the goods.

Contracts excluded from the Right of Free Resolution, as described above, include:

 

-Supply of goods made according to consumer specifications or clearly personalized;

 

-Supply of goods that, by their nature, cannot be returned or are likely to deteriorate or expire quickly;

 

-Supply of sealed goods not subject to return for reasons of health protection or hygiene;

 

-Supply of goods that, after delivery and by their nature, become inseparably mixed with other items;

 

-Any other exceptions contained in DL No. 24/2014, of February 14, when and if applicable.

 

CONSUMER GOODS WARRANTY

Products sold to Users/Clients, considered consumers for the purposes of consumer legislation, are covered by the legal regime of Sale of Consumer Goods and the related Guarantees, approved by Decree-Law No. 67/2003, of April 8, in its current version.

 

As a rule, the conformity of the goods purchased is guaranteed for a period of two years from the date of delivery of the product(s).

 

However, the food nature of the products sold means that the warranty period for food products supplied by Arcádia® may be shorter. The expiration dates are specifically indicated on all packaging of products supplied by Arcádia®, and these are the periods for which Arcádia® guarantees the conformity of the goods purchased.

 

If the purchased product shows any non-compliance, the User/Client must report the situation in writing, providing the order number and sending a detailed description of the defect, including photographic records of it. This should be done by one of the following means:

The costs of returning or collecting items that do not comply with the contract, which are within the warranty period, will be borne by Arcádia®.

 

In case of proven non-compliance of the good, the User/Client who is a consumer has the right to have it replaced, free of charge, by means of repair or replacement, an appropriate price reduction, or contract termination.

 

The replacement of the product, its repair, contract termination or price reduction must be carried out within 30 (thirty) days after verification of the defect.

 

If the verification and evaluation carried out on the product(s) reveal signs of non-compliance, namely regarding the conservation of the products, intentionally or negligently attributable to the User/Client, the same will not benefit from the aforementioned guarantees.

 

The request for replacement, price reduction or contract termination must be made by email to online@arcadia.pt, detailing full name, order number, choice of the option of replacement, repair, price reduction or contract termination and must necessarily include photographic records of the product.

 

In case of replacement, Arcádia® sends a new product to the client, which will be delivered upon collection of the damaged product, without any charge to the Client/User.

 

In case of contract termination, Arcádia® schedules the product pickup, and once the product is delivered to its facilities, a full refund of the product value will be made.

 

For this purpose, the User/Client must indicate in the email the bank details so that the refund can be processed.

 

LIABILITY

All products marketed on the website https://arcadiachocolates.com comply with Portuguese legislation.

 

Arcádia® is not responsible for damages resulting from interference, interruptions, computer viruses, malfunctions or disconnections of the operating system that may temporarily prevent access, navigation or the provision of services to the User/Client.

 

Likewise, Arcádia® cannot be held responsible if the failure to fulfill its obligations is attributable to an unforeseeable or insurmountable act of a third party, that is, due to a force majeure reason.

 

It is the sole responsibility of the User/Client to keep their Client account information correct and updated, through the Client Area of our website, or through our Customer Support service.

 

Arcádia® declines any responsibility for any delay or impossibility in processing the order, namely at the time of delivery, resulting from error or insufficiency or error in the data provided by the User/Client.

 

The item(s) sold are described and presented on the website with the utmost accuracy possible. If, despite all our precautions, errors occur on the website or in Arcádia® catalogs, it will not be held responsible for such fact.

 

Except in the case of application of the consumer legislation explained above, any transaction between Arcádia® and its Users/Clients, not contested through the appropriate channels within a period of 6 (six) months, may not give rise to any claim or liability of Arcádia®.

 

The User/Customer does not have the right to transmit, assign, record, or otherwise transfer a contract or any of the rights and obligations derived from it for their benefit or to themselves, without prior written consent on a durable medium from Arcádia®.

 

Arcádia® may transmit, assign, record, subcontract, or otherwise transfer a contract or any of the rights and obligations derived from it for its benefit or in its favor, at any time during the term of the contract, provided that this does not diminish the contractual or legal guarantees of the User/Customer.

 

The non-exercise of any right held by Arcádia® does not correspond to a waiver or limitation of those rights or actions, nor will it exempt the User/Customer from fulfilling their obligations, reserving the possibility to exercise their rights within the legally prescribed period.

 

FORM OF COMMUNICATIONS

Under applicable law, by using this website, the User/Customer accepts that, as a rule, communications will be made in writing and on a durable medium.

 

In this regard, as a rule, contact with the User/Customer will be made through the email address provided by them.

 

Furthermore, whenever necessary, Arcádia® will post notices to Users/Customers on this website.

 

Thus, the User/Customer accepts the use of electronic communication means and acknowledges that all contracts, notifications, information, and other communications sent electronically satisfy the legal requirement that such communications be made in writing. This condition will not affect legally recognized rights.

 

LOYALTY PROGRAM – ARCÁDIA CLUB®

What is it?

 

The Arcádia Club is Arcádia®'s loyalty program, through which benefits are granted to customers for their preference in consumption.

 

How to join?

 

Membership in the program is free, and customers can join through the website. If you wish to register now, click here.

 

Who can use it?

 

Membership is nominal and the benefits granted are strictly personal; it is not possible to sell or lend membership data. Each member has only one participation in the program, and member identification in the program participation is personal and non-transferable. Each member's data cannot be transferred to third parties, and the user is responsible for all operations carried out with, for, or through their account.

 

What are the benefits?

 

Arcádia® awards members of the Arcádia Club 1 point for every €10.00 spent on products; upon accumulating 5 points, you earn a €2.50 voucher that can be used on future purchases at Arcádia physical stores.

 

Occasionally, Arcádia® may offer special temporary promotions exclusive to members of the Arcádia Club.

 

Where to use?

 

It is the responsibility of Arcádia® to define the Stores to be included in this Program, and it may change the list of participating stores at any time.

Conditions, Cancellation, and Changes to the Program

 

Arcádia® reserves the right to change the criteria for granting benefits provided in the Clube Arcádia program, as well as to cancel or change the program conditions.

 

A condition for using the benefits is the identification of members in the Clube Arcádia program through the Client's mobile phone number. Arcádia reserves the right to cancel participation and benefits of the Clube Arcádia whenever the member does not comply with the Terms and Conditions of this program, does not meet the described conditions, or uses it abusively and/or fraudulently.

 

The benefits granted by the Clube Arcádia program are not compatible or cumulative with those of other ongoing promotions, except in cases where otherwise indicated.

 

At any time, the member may decide to cancel their membership in the Clube Arcádia program by requesting it through the contact online@arcadia.pt. Cancellation implies leaving the program, ending the member's relationship with the program, and extinguishing the member's benefits under this program.

 

In the eventual termination of the Clube Arcádia program, the Client acknowledges that any points they have in their favor will be automatically canceled, with no right to compensation.

 

OUT-OF-COURT RESOLUTION OF CONSUMER DISPUTES:

In case of dispute, the User/Client may resort to an Alternative Consumer Dispute Resolution Entity.
